Effective July 15, 2026. These terms govern use of this website, our software products, inquiries, discovery calls, proposals, creative services, website builds, AI systems, and related project work with Envisionary Design.
Use Of This Website
By using this website, installing or using our software, submitting a form, booking a call, or engaging Envisionary Design for services, you agree to these Terms of Service. If you do not agree, do not use the website or software or submit information through them.
Services
Envisionary Design provides brand design, website design, graphic design, logo redesign, fractional creative direction, content systems, AI-assisted workflows, strategy, and related creative services. Specific deliverables, timelines, fees, revisions, and responsibilities are defined in a written proposal, estimate, statement of work, invoice, or project agreement.
Discovery Calls And Proposals
A discovery call does not create a client relationship by itself. Proposals and estimates are based on information available at the time and may change if project scope, timing, content, technical requirements, integrations, or client needs change.
Client Responsibilities
- You agree to provide accurate information, timely feedback, project materials, approvals, credentials, and access needed to complete the work.
- You are responsible for reviewing deliverables, copy, claims, legal compliance, regulated-industry requirements, and final approvals before publication.
- You are responsible for licenses, subscriptions, hosting, domains, third-party accounts, ad accounts, plugins, fonts, stock assets, and platform fees unless otherwise agreed in writing.
Payments
Payment terms are stated in the applicable proposal, invoice, or agreement. Work may be paused for overdue invoices. Deposits, retainers, strategy fees, rush fees, and completed work may be non-refundable unless otherwise stated in writing.
Revisions And Scope
Included revisions are limited to the scope described in the project agreement. New pages, new concepts, new functionality, additional rounds, copy rewrites, platform changes, urgent requests, technical troubleshooting, or work outside the agreed scope may require additional fees.
Intellectual Property
Unless otherwise agreed, Envisionary Design retains ownership of preliminary concepts, unused directions, internal processes, templates, frameworks, working files, scripts, automation systems, and pre-existing materials. After full payment, the client receives the rights stated in the project agreement for final approved deliverables.
Third-party materials such as fonts, stock assets, software, plugins, APIs, code libraries, hosting platforms, and embedded tools remain subject to their own licenses and terms.
Portfolio And Case Studies
Unless otherwise agreed in writing, Envisionary Design may reference completed work, public websites, public campaign assets, client names, screenshots, and project outcomes in portfolios, case studies, proposals, social media, and marketing materials. Confidential information will not be knowingly published without permission.
AI-Assisted Work
Some services may use AI tools for drafting, ideation, analysis, automation, image generation, content production, or workflow support. AI output can contain errors and must be reviewed. Final approval, factual accuracy, legal compliance, and use of published materials remain the client's responsibility unless a separate written agreement states otherwise.
No Guaranteed Results
We do not guarantee specific rankings, traffic, leads, sales, revenue, ad performance, search placement, AI citations, platform approval, or business outcomes. Strategy, design, SEO, content, analytics, and AI systems can improve the quality and structure of a marketing asset, but market response depends on many factors outside our control.
Third-Party Platforms
Websites and campaigns may rely on third-party platforms such as hosting providers, domain registrars, analytics tools, CRMs, schedulers, payment processors, ad platforms, email systems, APIs, and social networks. Envisionary Design is not responsible for outages, pricing changes, account restrictions, policy changes, data loss, or failures caused by third-party services.
FINEPRINT DEFCON Browser Extension
These terms apply to the FINEPRINT DEFCON browser extension in addition to the rest of these Terms of Service.
Informational Use Only; Not Legal Advice
The extension generates automated, intentionally dramatized commentary about Terms of Service and Privacy Policy documents. Its scores, threat levels, and characterizations are opinion and estimation, not legal advice, a professional opinion, or a statement of fact about any company. Do not rely on it for legal, financial, or compliance decisions. Consult a qualified attorney for legal questions.
Accuracy
Automated analysis, including AI and keyword scanning, can be incomplete, wrong, or out of date. Offline mode in particular is a rough keyword estimate. You are responsible for verifying anything before acting on it.
Bring Your Own AI Provider
The extension requires your own third-party API key for AI-provider analysis. Your use of Anthropic, OpenAI, or Google is governed by that provider's terms, and you are responsible for all usage and charges on your own accounts.
Sharing And Your Responsibility
The extension can help you compose posts for third-party platforms such as X. Any content you choose to publish is your own statement, published at your discretion. You are solely responsible for what you post, including ensuring it is truthful and lawful. Envisionary Design is not the publisher of and is not responsible for content you share, and the pre-filled text is a starting draft that you must review and edit before posting.
No Warranty
The extension is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that it will be accurate, uninterrupted, error-free, or compatible with any site or browser.
Extension Limitation Of Liability
To the fullest extent permitted by law, Envisionary Design is not liable for any damages arising from use of the extension, including decisions made or content published based on its output. Because the extension is provided free of charge, the liability cap for paid projects stated below does not create any obligation with respect to the extension.
Changes And Availability
The extension is offered free and may be changed, limited, or discontinued at any time without notice.
Limitation Of Liability
To the fullest extent permitted by law, Envisionary Design will not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from website use, project work, third-party tools, delays, technical issues, or business outcomes. Total liability for a paid project is limited to the amount paid to Envisionary Design for the specific service giving rise to the claim.
Changes To These Terms
We may update these terms from time to time. The effective date above shows the latest version. Continued use of the website or services after changes are posted means you accept the updated terms.
